How to Apply for A Divorce in Australia

  • Choose between a Sole or Joint Application: You can apply for a divorce on your own (sole application) or together with your spouse (joint application). If applying alone, you must formally notify your spouse about the application.
  • Ensure you meet the requirements: Before applying, you need to be separated for at least 12 months and show that the marriage has permanently broken down. You also need to confirm jurisdiction, such as being an Australian citizen or resident.
  • File your application online: Submit your divorce application through the Commonwealth Courts Portal, paying the necessary fees. Make sure all required documents, including your marriage certificate, are attached.
  • Court hearing: A court hearing may be required if you’ve applied on your own or if there are children under 18. If no hearing is needed, the application can proceed based on the paperwork submitted.
  • Divorce Order: If the court approves your application, a Divorce Order is granted and becomes final one month and one day after the hearing, officially ending the marriage.
